1. Membership
1.1 The purpose of the PAK’nSAVE Sticky Club programme (“Sticky Club”) is to reward our regular PAK’nSAVE customers who become members, with benefits that are not available to other shoppers, through the issue and use of a Sticky Club Tag.
1.2 Sticky Club is operated by Foodstuffs (N.Z.) Limited (“Foodstuffs”).
1.3 Sticky Club is only available in PAK’nSAVE South Island stores. In addition, you can only scan your Sticky Club tag at a South Island store.
1.4 Sticky Club membership is free. To join, simply pick up a Sticky Club Tag in-store and register it at the Customer Services desk or by phoning the Sticky Club Call Centre on 0800 80 75 75 during normal business hours.
1.5 To join Sticky Club, you must provide us with a valid email address as we will primarily communicate Sticky Club member benefits to you via email. Without an email address we will be unable to provide you with the full benefits of being a Sticky Club member. Once you’re a member you can log into your existing Sticky Club member account at stickyclub.co.nz at any time and update your communication preferences.
1.6 Sticky Club is primarily intended as a programme for individuals. However from time to time Foodstuffs may in its absolute discretion accept applications from businesses, organisations and societies to join. You may apply to register your New Zealand business, organisation or society to Sticky Club by providing your business, organisation or society’s name and relevant contact details including physical business address, postal address, phone number and email address at the time of registration. You will still need to provide a contact name for an individual at your business, organisation or society. Notwithstanding the above, individuals or businesses purchasing goods from PAK’nSAVE for the purposes of resale will not be eligible to join Sticky Club.
1.7 Sticky Club is intended for use by people located in New Zealand and is not intended for use by people located outside New Zealand. All Sticky Club members must be residents of New Zealand and have a valid New Zealand physical address and postal address.
2. Acceptance of terms and conditions
2.1 These Terms and Conditions (together with any amendments from time to time) govern Sticky Club. Submitting a Sticky Club member registration (either for yourself or on behalf of a Sticky Club Household member), any use of your Sticky Club Tag or membership number, or any other participation in Sticky Club will be deemed acceptance of these Terms and Conditions.
2.2 Foodstuffs reserves the right to amend the Sticky Club Terms and Conditions, at any time, and will communicate any changes by publishing revised Terms and Conditions at stickyclub.co.nz. Your continued participation in Sticky Club following any changes to the Terms and Conditions will be deemed acceptance of the updated Terms and Conditions.
3. Sticky Club Tag and Member Account
3.1 The Sticky Club Tag is issued by and remains the property of Foodstuffs, and must be returned to Foodstuffs on request or destroyed when no longer valid or required by us.
3.2 When you first set up your Sticky Club member account you will be asked to create a password to prevent unauthorised access to your account. Once your member account is set up, you will be able to log into stickyclub.co.nz to update your member account details.
3.3 Your Sticky Club Tag can only be used at PAK’nSAVE stores in the South Island to use SHOP’nGO or to earn Coffee Stamps (at participating PAK’nSAVE stores with an in-store café only).
3.4 You may only have one Sticky Club Tag registered in your name at any one time.
3.5 If your Sticky Club Tag is lost or stolen you must immediately log in to your member account or contact the Sticky Club Call Centre on 0800 80 75 75 and:
• place your Tag on hold (until you find your Tag again); or
• register a replacement Tag against your existing Sticky Club member account.
To replace your Tag, you will first need to pick up a new Tag from a PAK’nSAVE South Island store.
3.6 Where a Sticky Club Tag is lost or stolen, Foodstuffs is not responsible for any loss of member benefits, including but not limited to Coffee Stamps balances. In addition, we cannot guarantee that all member benefits earned prior to the date of loss or theft of the Tag will be available for use on your replacement Tag.
3.7 The Sticky Club Tag is not transferable, cannot be copied, bought or sold, and can only be used by the member who is registered against the Tag to use SHOP’nGO or their partner/spouse or other immediate family member to collect or redeem Coffee stamp balances. Proof of identification may be requested at any time.
3.8 Your Sticky Club Tag is not a credit card, debit card or gift card and you cannot load money onto the Tag.
4. Sticky Club Households
4.1 If a number of individuals live at the same address and share the shopping, they may wish to form a Sticky Club Household (‘Household’) for the purposes of pooling their membership benefits together.
4.2 An existing Sticky Club member may create a Sticky Club Household by either of the following methods:
4.2.1 Invite other existing Sticky Club members: As an existing Sticky Club member you can invite another Sticky Club member who lives at the same residential address as you to join your Sticky Club Household. You can do this by logging into your member account at stickyclub.co.nz, or by contacting the Sticky Club Call Centre on 0800 80 75 75. The invited member will be sent an invitation by email and if they accept, will be joined to your Household from the date that they accept the invitation. If the invited member declines or does not respond to the invitation, then they will remain as an individual member of Sticky Club and will not be joined to your Household.
4.2.2 Register a new member to Sticky Club and your Household: You may on behalf of someone else living at your residential address who is not already a Sticky Club member, register that person as a new member of your Sticky Club Household, so long as you have their express consent to do so. To do this, you will first need to pick up a new Sticky Club Tag at a PAK’nSAVE South Island store. You will then need to log into your member account at stickyclub.co.nz and complete the registration form (located on the ‘My Household’ page) by entering the Tag number (printed on the reverse of the Tag) together with basic contact information for the individual including first name, last name, gender and date of birth. You must also declare that you have the express consent of the named individual to provide their personal information for the purposes of registering them for Sticky Club.
4.2.3 Once registered, you must hand over the Sticky Club Tag to the new member. To maximise the benefits available, they should then complete their Sticky Club member registration and become an active member of Sticky Club.
4.3 If you have been registered for Sticky Club by another member of your Household, by using your Sticky Club Tag, you consent to being a Sticky Club member and to us using your personal information for the purposes of administering and promoting Sticky Club. To enjoy the full benefits of Sticky Club, you should also complete your Sticky Club member registration by providing your contact details including email address and contact phone number. You can do this by logging into your member account at stickyclub.co.nz or by contacting the Sticky Club Call Centre on 0800 80 75 75.
4.4 There is a limit of 4 members per Sticky Club Household although there may be more than one Sticky Club Household group set up at the same residential address. You may only belong to one Sticky Club Household at any one time. If you currently belong to a Sticky Club Household and wish to join a different Household, you must first leave the existing Sticky Club Household. You can do this by logging into your member account at stickyclub.co.nz or by contacting the Sticky Club Call Centre on 0800 80 75 75.
If you join a Sticky Club Household, your current Coffee Stamps balance (if any) will be added to the Household’s balance.
4.5 The Sticky Club member who initiated the formation of the Sticky Club Household is referred to as the ‘Head Honcho’ and that person will be responsible for managing the membership of all members of the Household.
4.6 As a condition of joining a Sticky Club Household, a member consents to the Head Honcho managing the Household on their behalf and in particular being responsible for the following activities:
4.7.1 Managing the Household membership. The Head Honcho may invite, join or delete members from the Household at any time, so long as there are no more than 4 members per Household at any one time.
4.7.2 Updating the Household address. The Head Honcho is responsible for updating the Household residential address should it change. This will also update the address of individual Sticky Club members of that Household.
4.7.3 Change the Household’s Head Honcho. Where the Head Honcho is leaving the Household, or no longer wishes to be the Head Honcho, that person may invite another existing Sticky Club Household member to become the new Head Honcho for the Household. If the invited member accepts the invitation they will immediately replace the existing Head Honcho and will assume all responsibility for managing the Household. If the invitation is not accepted, the Head Honcho will remain unchanged. The Head Honcho may then choose to either remain as the Head Honcho, invite another Household member to become the Head Honcho, or delete the Household.
4.7.4 Delete the Sticky Club Household. The Head Honcho may delete the Household at any time. Once a Sticky Club Household is deleted, Sticky Club members are free to join another existing Household at their residential address, form a new Household of their own or remain as an individual member of Sticky Club. Any accrued Coffee Stamps balance at the time the household is deleted will be retained by the Head Honcho.
4.8 If you are part of a Sticky Club Household and are subsequently removed from the Household by the Head Honcho, you are free to join another existing Household at your residential address or form a new Household of your own. However, any Coffee Stamps purchases that you contributed to the Household will be retained by the Head Honcho and you will not be able to take them with you.
5. Sticky Fuel
5.1 From 1 December 2020, you will not be able to claim fuel discounts as part of your Sticky Club membership. This means that Sticky Club members can no longer accumulate savings on fuel by shopping at participating PAK’nSAVE South Island stores. For clarity, this applies to both the base earn rate (1 cent-per-litre saving on fuel for every $20 spent in a single transaction) and bonus product offers.
6. Sticky Coffee Deal
6.1 A Sticky Coffee Deal is a special offer that rewards Sticky Club members for purchasing any 8 hot drink beverages from a participating PAK’nSAVE in-store café with a free hot drink reward of their choice.
6.2 Sticky Coffee Deals are only available at participating PAK’nSAVE South Island stores with an in-store café ( currently excludes PAK’nSAVE Hornby, Invercargill, Northlands, Riccarton & Richmond).
6.3 To qualify for a free hot drink reward you must scan your Sticky Club Tag at a participating PAK’nSAVE café checkout at the time of each individual qualifying purchase to earn a Coffee Stamp.
6.4 Qualifying hot drink purchases can be made over multiple transactions at any participating PAK’nSAVE South Island store with an in-store café. Your Sticky Club account will keep track of your purchases and you can view your current Coffee Stamps balance on your till receipt or in your weekly Sticky Club email.
6.5 Any transactions involving qualifying hot drink purchases that are subsequently returned and refunded in full, will result in your current Coffee Stamps balance being adjusted by deducting the corresponding Coffee Stamps counter of the refunded transaction.
6.6 Qualifying hot drink purchases cannot be retrospectively applied once a transaction has been completed if you forget to scan your Sticky Club Tag at the time of purchase.
6.7 When you reach the qualifying threshold for a free hot drink reward i.e. earn 8 Coffee Stamps, the free hot drink reward will automatically be loaded against your Sticky Club Tag. Your free hot drink reward does not expire and you can choose when you wish to redeem it.
6.8 To redeem your free hot drink reward, you must advise the PAK’nSAVE in-store Café attendant that you wish to redeem it and scan your Sticky Club Tag at the time of purchase.
6.9 You may earn as many free hot drink rewards as you wish by purchasing qualifying hot drink beverages from any participating PAK’nSAVE South Island in-store café.
6.10 Free hot drink rewards are only available for use by the individual member (or Sticky Club Household) that earned the reward and are not transferable to another member or exchangeable for cash or any other reward.
6.11 If you are part of a Sticky Club Household, your individual Coffee Stamps balance will be combined with those of your other Household members to earn a free hot drink reward faster.
6.12 A free hot drink reward can only be redeemed once. If you are part of a Sticky Club Household, the free hot drink reward will be granted to the first Household member who scans their Sticky Club tag at a participating PAK’nSAVE in-store café (initially South Island stores only) and chooses to redeem the reward.
7. Your Responsibilities as a Sticky Club Member
7.1 Up to date contact details – As a Sticky Club member, you must provide us with your correct full legal name and personal contact details such as your residential address, postal address, phone number and email address. Please update your Sticky Club member account with any changes to your personal or membership details at stickyclub.co.nz or by advising the Sticky Club Call Centre on 0800 80 75 75. Foodstuffs will not be liable for any loss of benefits resulting from your details being out of date or inaccurate and may exercise its rights under clause 8.1.
7.2 Keep your Sticky Club Household account up to date – If you are the Head Honcho of a Sticky Club Household, you agree to keep the contact details of the Household up to date. In addition, you agree to inform the other members of the Household of any important changes to the Household such as membership or Household address changes.
7.3 New member registrations to your Sticky Club Household – If you register a new member to the programme (and consequently to your Sticky Club Household), you must arrange for that individual member to complete their Sticky Club member registration as soon as possible by logging into their member account at stickyclub.co.nz or by contacting the Sticky Club Call Centre on 0800 80 75 75.
7.4 Protect your Sticky Club account and password - You are responsible for the safe-keeping of your Sticky Club Tag and protecting access to your Sticky Club member account, including any security details such as your password or security question and answer. You must notify Foodstuffs immediately if your Sticky Club Tag is lost or stolen or of any unauthorised use of your account and/or password or any other breach of security. We will not be held responsible for any loss you suffer arising from you failing to safe-guard your Sticky Club Tag, your password or any other security details.
8. General
8.3 On the death of an individual Sticky Club member their Sticky Club membership will terminate. Any unused or other benefits earned but not redeemed at the time of the member’s death will be cancelled for no consideration. On a Sticky Club Household member’s death, Foodstuffs may allocate any benefits earned to the remaining Household members. Accrued benefits may not otherwise be transferred. Where Foodstuffs learns of a Head Honcho’s death and if the remaining Household members have not in a reasonable time elected a new Head Honcho, Foodstuffs may in its discretion elect a new Head Honcho. In doing so Foodstuffs may take into account other Household members’ preferences.
9. Privacy
9.1 Foodstuffs through its related companies, Foodstuffs South Island Limited and Foodstuffs North Island Limited, collects and holds personal information in accordance with its obligations under the Privacy Act 1993 (Privacy Act).
9.2 From time to time Foodstuffs may need to obtain personal information from you in the course of providing the Sticky Club programme to you. Personal information is any information about you that identifies you, or by which your identity can reasonably be ascertained. To register with Sticky Club, you will need to provide Foodstuffs with certain personal information, which may include your name, address, email address, phone number and other requested information. In addition, we may collect various information from you when you purchase goods or services from us or scan your Sticky Club Tag (including transactional data).
9.3 By joining and participating in Sticky Club and using your Sticky Club Tag, you agree that Foodstuffs may collect, store and use your personal information to do any of the following:
• contact you in relation to your Sticky Club membership and provide you with the benefits of being a Sticky Club member and having a Sticky Club Tag;
• contact you (or allow a PAK’nSAVE store staff member to contact you) in relation to store transactions where you have scanned you Sticky Club Tag;
• identify and determine member benefits, offers or promotions that may be relevant to you, your family or Household based on what you like to buy;
• provide you (or allow a third party to provide you) via email, online (Sticky Club website or social media channels) or by post with details of special offers, discounts, prize draws, competitions and information about products and services offered by Sticky Club, PAK’nSAVE or other brands, that may be of interest to you, your family or Household;
• conduct research related to your supermarket shopping including sending you invitations to complete surveys from time to time;
• use your personal information for other Foodstuffs marketing and promotional purposes;
• take actions required to keep your information secure;
• undertake data analytics, insights or data mining (including the anonymisation or aggregation of your personal information with other data) to identify patterns and trends, and use the full benefit of that analysis.
• from time to time we may use your data to target you through social media channels, like Facebook. In this case, we match encrypted (hashed) email addresses with encrypted Facebook data to identify a match in a secure environment. The hashed data is deleted as soon as the match is complete and never kept or used by Facebook or shared with any third party, and
• Such other purposes we make known to you at the time of collection.
9.4 By joining Sticky Club and using your Sticky Club Tag, you agree that Foodstuffs may share your personal information to third parties for the purposes listed in clause 10.3 and in particular that Foodstuffs may also share your personal information to our related companies including Foodstuffs South Island Limited and Foodstuffs North Island Limited, agents working on behalf of Foodstuffs (such as mailing companies, research companies, data hosting suppliers and other suppliers), Foodstuffs North Island Limited and Foodstuffs South Island Limited’s suppliers, and a Foodstuffs North Island Limited or Foodstuffs South Island Limited franchisee PAK’nSAVE store owner or store staff member for the purposes set out in clause 10.3, provided that unless required by law, we will not otherwise pass on your personal information to a third party.
